I Do Drive Thru Service Agreement

We are excited to have you on board and ask, as your Booking Agent, that you read our Booking Terms and Conditions.

 

This agreement is made between I Do Drive Thru, herein referred to as the “Booking Agent” residing in an online capacity and The Marrying Couple whom shall indicate, with a tick at Checkout, that they have read and agree to all terms and conditions, prior to a deposit being paid on our website.

 

  1. NATURE OF THE CONTRACT

Booking Agent commits to booking the highest calibre Officiant and, if requested, Photographer to provide wedding services to The Marrying Couple for their requested time, date and location for an elopement.

Booking Agent shall manage and maintain an up to date website and to respond to enquiries and shall receive and respond to enquiries in a timely fashion.  Once enquiries are finalized, The Marrying Couple shall be appointed a Wedding Officiant (Who shall be known as ‘Officiant’) to complete all paperwork and legal proceedings in relation to the marriage and if applicable, to a Wedding Photographer (who shall be known as ‘Photographer’) to complete all photography and /or film requirements as agreed during the wedding.

The Officiant will be supplied by the Booking Agent to render Wedding Officiating services for the Marrying Couple. This service will occur (after the remaining fee is paid directly to the Officiant,) at the date, time and location specified and agreed by both parties. This service will be contracted by a separate Service Agreement, which must be signed and dated in accordance with the Officiant’s own terms and conditions. The booking is not finalised until the Wedding Officiant has confirmed payment has been received, marriage licence is in order and time and date of ceremony has been agreed upon, this will be set out in an email confirmation as written by the Officiant.

A Photographer may also be engaged to take film and/or photos of the wedding and again they will be booked to complete all steps necessary to document the wedding of The Marrying Couple. In this case the The Photographer and the Officiant will be booked to render the marriage and photographic service (after the remaining fee is paid to them directly,) at the date, time and location specified. This service will be contracted by a separate Service Agreement, which must be signed and dated in accordance with the Officiant and Photographer’s own terms and conditions.

2. EXTERNAL SERVICES

Booking Agent is not responsible for any car hire bookings, or any other venue or location bookings for the marrying couple, or any other external services.  Recommendations may be made via website or email for external services, but provision and supply of these services is beyond our control and the Booking Agent bears no responsibility.  It is up to the marrying couples own discretion if they choose to use external services.

 

3. RESPONSIBILITIES OF THE BOOKING AGENT

1. Booking agent shall in a timely fashion respond to enquiries and assign an Officiant and/or Photographer for the purposes of the wedding ceremony

2. Booking Agent shall be available for responses and enquiries during the time that the Officiant is being utilized by the marrying couple

3. Booking agent shall work to represent the Officiant and Photographer and shall assist to ensure a high quality of service is given

4. The Booking Agent takes no responsibility herein for any agreements made outside this contract or the Officiant and/or Photographers contract

5. The Booking Agent shall be responsible for maintaining the ceremony choices section of the website (hereby known as ‘the Portal-O-Love’) and get all choices/options/paperwork to the Officiant and/or Photographer in a timely fashion

 

4. TIME AND PLACE OF THE CEREMONY

The Marrying Couple shall adhere to the contract terms and conditions as set out by the Officiant. Travel and Parking fees will be quoted individually and Public Holiday rates apply (additional $100). Any permits for outdoor or bookings for privately owned locations are the responsibility of the Marrying Couple.

 

5. MARRIAGE LICENCE

The Marrying Couple shall adhere to the contract terms and conditions as set out by the Officiant.

 

6. DEPOSIT

Deposit for the wedding service shall be paid via the I Do Drive Thru Website vis PayPal or Stripe, and at the time of payment the Booking Agent Service Agreement shall be ticked as bring read and agreed to. The Deposit is non-refundable under any circumstances.

7. BALANCE OF FEES PAYABLE

Invoice will be issued to the Marrying Couple by the Officiant. Invoice prices are final and are not negotiable. Travel and parking fees for the Officiant and Photographer shall be included in final invoice price.

 

7. PAYMENTS

Full payment in the amount of $500 USD (plus possible travel and parking fees) are required to officially reserve the date and time for the Officiant for the Ceremony.  No dates will be held until full payment is made and Service Agreement for the I Do Drive Thru and the Wedding Officiant is ticked and understood as having been read. 

Payment may be made electronically via PayPal or Stripe (Apple Pay, Credit Card) to the Officiant.

 

8. CEREMONY START TIME

The Officiant creates their own terms and conditions surrounding lateness of the couple, changes of date and changes of location, and such will be stipulated in their contract.

 

9. SOCIAL MEDIA USE AND PHOTOGRAPHY

The couple hereby agree to allow the I Do Drive Thru and its representatives, along with the Officiant and the Photographer the right to use images within their social media profiles, websites and media appearances, unless otherwise specified. The Marrying Couple give consent to the sharing of information on the social media profiles, websites and media appearance of the couple’s names, wedding date and wedding location.

 

10. NON-DISPARAGEMENT

The Wedding Couple agrees that they will not disparage the I Do Drive Thru, its Officiants, its Photographers or any of their employees.  For purposes of this Service Agreement, “disparage” shall mean any negative statements, whether written or oral, about the Wedding Officiant, the WeddingPhotographer or the I Do Drive Thru Services.  The parties agree and acknowledge that this non-disparagement provision is a material requirement for this Service Agreement, the absence of which would have resulted in the Officiant, Photographer and I Do Drive Thru refuse to work with the Wedding Couple. 

11. CANCELLATIONS

The Marrying Couple understands that the Officiant and Photographer has a specifically booked date and time for the terms of this agreement.  And if a cancellation is needed for any of these provisions the Wedding Couple will forfeit their payment and services will terminate.

 

12. CHANGES - DATE, TIME AND/OR LOCATION

The Wedding Couple understands and recognizes that any time/date/location changes must be made directly with the Officiant and Photographer and must be agreed upon before the changes will be accepted. There may be additional fees at the Wedding Officiants discretion to make any changes.

 

THIS SERVICE AGREEMENT CONSTITUTES THE ENTIRE AGREEMENT BETWEEN THE PARTIES AND MAY NOT BE MODIFIED EXCEPT IN WRITING WHEN SIGNED BY BOTH PARTIES. 

NO OTHER REPRESENTATIONS OR PROMISES HAVE BEEN MADE EXCEPT THOSE THAT ARE SET OUT IN THIS AGREEMENT.
